Cancellation & Refund Policy

1. Booking Confirmation

A charter reservation is considered confirmed once:

  • The required deposit or full payment is received, and

  • Written confirmation is issued by VIRA Charters.

By confirming a reservation, the Client agrees to this Cancellation & Refund Policy.


2. Client-Initiated Cancellations

All cancellation requests must be submitted in writing via email.

More than 7 Days Before Departure

Cancellations made more than seven (7) days prior to the scheduled departure time may be eligible for a partial refund, less:

  • Administrative processing fees

  • Payment transaction fees

  • Any non-recoverable service costs

Within 7 Days of Departure

Cancellations made within seven (7) days of the scheduled charter are non-refundable.

48 Hours or Less / No-Show

Cancellations within forty-eight (48) hours of departure, late arrivals exceeding 30 minutes without notice, or failure to appear at the scheduled dock time are considered a no-show and are non-refundable.


3. Weather-Related Cancellations

Safety is the highest priority.

Weather decisions are made solely by the assigned captain based on:

  • Official marine advisories

  • Wind conditions

  • Thunderstorm warnings

  • Small craft advisories

  • Unsafe sea state

Light rain, cloudy conditions, or passing showers do not automatically qualify as unsafe weather.

If the captain determines that conditions are unsafe prior to departure, the Client may choose between:

  • Rescheduling (subject to availability), or

  • Receiving a refund for the charter fee.

If weather conditions change during the charter after departure, partial refunds are not guaranteed, as operational and time costs have already been incurred.


4. Captain or Mechanical Cancellation

In the rare event of:

  • Mechanical failure

  • Crew unavailability

  • Safety-related operational issues

VIRA may:

  • Offer a comparable substitute vessel (if available),

  • Reschedule the charter, or

  • Issue a full refund.

VIRA shall not be liable for additional travel expenses, lodging, or third-party costs incurred by the Client.


5. Late Arrival Policy

Charters begin and end at the agreed scheduled time.

Late arrival by the Client does not extend the charter duration and does not qualify for partial refund.

Overtime may be offered at the discretion of VIRA and subject to availability at an additional hourly rate.


6. Early Termination

If a charter is terminated due to:

  • Violation of onboard rules

  • Unsafe behavior

  • Illegal substances

  • Excessive intoxication

No refund will be issued.


7. Payment Disputes & Chargebacks

By completing payment, the Client acknowledges acceptance of this policy.

Initiating a chargeback without valid contractual grounds may result in legal action and recovery of associated administrative costs.


8. Force Majeure

VIRA shall not be held responsible for cancellations or delays caused by events beyond reasonable control, including but not limited to:

  • Government restrictions

  • Natural disasters

  • Port closures

  • Acts of God

In such cases, rescheduling may be offered at VIRA’s discretion.


9. Refund Processing

Approved refunds will be processed using the original payment method within 5–10 business days, depending on financial institution processing times.

Transaction fees may be non-refundable.


10. Policy Modifications

VIRA Charters reserves the right to update this Cancellation & Refund Policy at any time. The version in effect at the time of booking will apply.
